Developing Cannabis Testing Standards in the SA Workplace
Following the Prince decision decriminalising cannabis and the Labour Appeal Court’s ruling in Enever, which declared the employer’s cannabis testing system irrational and discriminatory, South African employers remain in search of a rationally grounded drug testing methodology. The continued use of urine testing is fundamentally flawed, as it detects past or inaccurate drug impairment rather than current unfitness for work. Our speakers will draw on recent research conducted by Thato Lentsoe to provide a practical pathway for South African employers to adopt more rational and legally defensible drug testing policies.
